根据ISF向其成员发布的通知,不具备完整的STCW 95公约证书本身不应作为滞留的依据。ISF指出,有关规定要求,只有在证书不完备对人命、财产或环境构成威胁时才对船舶进行滞留。但是,ISF认为,在没有其它理由证明有关船员不符合STCW标准的情况下,PSC检查官应无权仅仅因为船缺乏必要文件而对船舶进行滞留。在缺乏船旗国签署认可的情况下,如果船员持有由原劳务输出国签发的有效STCW证书并且具有向船旗国申请认可的书面证明,那么该船通常不应被滞留。
According to notices issued to its members by the ISF, failure to have a complete STCW 95 Convention Certificate itself should not be used as a basis for detention. The ISF states that the regulations require that ships be stranded only when the certificate is incomplete, threatening human lives, property or the environment. However, the ISF considers that PSC prosecutors should not have the authority to hold a ship stranded simply because the ship lacks the necessary documents, in the absence of any other justification to prove that the crew concerned is not STCW compliant. In the absence of signatory approval by the flag State, the ship should normally not be detained if it holds a valid STCW certificate issued by the original exporting country of labor and has a written certificate of approval of the flag State.
