本文通过对民国时期定货契约习惯及违约纠纷裁处的考察,揭示商事习惯在维系交易秩序中的作用。认为尽管其时国家制定了独立的商法,商事习惯仍在维系交易秩序中发挥至关重要的作用。商事习惯通过不同形式的社会力量约束商行为,而不同的社会力量则构成对交易行为的多层管理体系。这是保证民国时期商务正常开展,商业渠道畅通的重要因素之一。
This article examines the practice of ordering contract and the settlement of default disputes during the Republic of China, and reveals the role of business customs in maintaining the order of transactions. It is believed that, though the country now has its own independent commercial law, commercial habits still play a crucial role in maintaining order in the transaction. Business practices restrict business practices through different forms of social forces, while different social forces form a multi-tiered management system of transactional behaviors. This is one of the important factors to ensure the normal commercial development during the Republic of China and the smooth commercial channels.
