澳大利亚是一个多民族多元文化融合的国家,其司法制度在英美法系国家中颇具特色,这些特色也表现在指控协商制度中。澳大利亚的指控协商制度不仅在名称上有别于辩诉交易制度,而且在司法实践的具体运作中,特别重视办案警察的意见及被害人的权利。我国在建立相关制度时可以借鉴澳大利亚的指控协商制度,使用一个更加贴近司法实践、便于为公众所接受的名称,并充分保障被害人的权益,以适应司法发展的趋向。
Australia is a country with multi-ethnic and multicultural integration. Its judicial system is distinctive in Anglo-American legal system countries. These characteristics are also reflected in the accusation and consultation system. The system of accusation and consultation in Australia is not only different from the system of plea bargaining in name, but also pays special attention to the opinions of the investigating police and the victim’s rights in the specific operation of judicial practice. When establishing the relevant system, our country can learn from the accusation and negotiation system in Australia and use a name that is more close to judicial practice and easier to be accepted by the public, and fully protects the rights and interests of victims so as to adapt to the trend of judicial development.
