关于死刑的存废是近几十年来一直在世界各国学界,实务届乃至社会中探讨的一个重大的问题。随着我国《刑法修正案》(八)的出台,废除了13个死刑罪名,又掀起了我国新一轮死刑存废的热烈讨论,众多学者已经从不同的角度切入尤其对现阶段我国死刑制度的宪法控制方面进行了深度的思考。本文从死刑与生命权的关系角度出发,试通过探讨三个方面的问题:宪法对生命权的保护从何体现?如何理解死刑在宪法中的体现?死刑制度与保护生命权究竟有无冲突?进而得出我国死刑是否应该废除的一些理由。
The abolition of the death penalty has been a major issue that has been explored in the academic circles, practical sessions and even in the society of various countries in the world in recent decades. With the promulgation of the “Criminal Law Amendment” (8) in our country, 13 counts of death penalty have been abolished, and a heated discussion has been set for the death penalty of a new round of death in China. Many scholars have made a special study of the death penalty system in our country at different stages The constitutional control of the depth of thinking. This article from the perspective of the relationship between the death penalty and the right to life, try to explore three issues: the constitution of the right to life from what embodiment? How to understand the death penalty in the Constitution? The death penalty system and the protection of the right to life whether there is any conflict? And then come to some reasons for whether the death penalty should be abolished in our country.
