一段时间以来,政界和学界有关宪政的呼声再次响起,掀起一股宪政热。关于宪政的争论不过两种,有人支持有人反对。支持者认为宪政具有普世价值,中国应该实行宪政;反对者则认为下保证是历史范畴,不具有普世价值,不适宜中国。纵观近代的政治历程,我国确实有宪政的历史,但百年宪政路在当时的社会历史条件下走得异常坎坷。综合历史实践和现实条件可知,不结合本国实际条件走宪政路注定以失败告终。中国目前尚不具备实行宪政的土壤,这一客观事实足以让一度高涨的“宪政热”冷下去。
For some time now, the voice of the political and academic circles on constitutional government sounded again, setting off a heat of constitutional government. There are only two kinds of debates about constitutionalism. Some support some opposition. Proponents argue that constitutionalism has universal values and that China should implement constitutionalism. Opponents believe that guarantees are a historical category, have no universal value, and are not suitable for China. Throughout the political history in modern times, our country did indeed have the history of constitutional government. However, the centuries-old constitutional government road went through unusual ups and downs in the social and historical conditions at that time. Based on the historical and practical conditions, we can see that the constitutional road is doomed to failure without combining the actual conditions in our own country. At present, China does not yet have the soil to implement constitutional government. This objective fact is enough to allow the once soaring “constitutional government” to go down.
