不论所处的地方是城镇还是农村,房产对于广大群众而言都是构成财产的重要部分。但是我国的现行法律是针对“城市国有土地的使用权、开发与交易”制定法律,所以在遇到用集体土地上的房产进行抵押时,各级房产行政主管就显得不知所措。本文将对集体土地上的房产到底能不能进行抵押这一问题进行初步探析。
No matter where the town or the village is located, real estate is an important part of property for the general public. However, the current law in our country is formulated in the light of the law on the right to use, develop and trade of state-owned land in urban areas. Therefore, in the event of mortgaging real estate on collective land, administrative supervisors of real estate at all levels become overwhelmed. This article will initially probe into the issue of whether real estate on collective land can be mortgaged.
