随着社会的不断发展,科学技术在司法程序中的应用越来越广泛,已经成为一些具有争议性事实的关键证明方式,发展前景非常广阔,然而在实践应用的过程中也暴露出了一些不容忽视的问题。从某种程度来看,在采纳、运用科学证据时,可以认为其同证明程序规则、证据相一致,并不存在矛盾,然而若应用到的程序规则具有非认知性特点,就必须要予以撤除。在判断法庭科学证据可靠程度的过程中,判断能否可以作为证据的主要依据就是取得的法庭证据是否符合科学标准。本研究主要结合当前法庭科学的发展现状,阐述了司法环境中科学和法律的关系,对司法诉讼中的社会科学和人类科学证明进行了分析,探究了法庭科学证据的可靠性,最后总结了司法环境下各种证据的科学有效性标准,以期实现科学技术方法的实际效用,改善社会和法庭科学证据的可靠程度,增强证据的质量。
