小产权房问题由来已久,其根植于复杂多变的当代社会环境中,是迅速发展的市场经济与相对滞后的法律制度现状所造就的。随着房地产市场竞争加剧,商品房价格不断攀高,老百姓的刚性住房需求与高昂的房价形成了巨大的矛盾,更多向小产权房市场倾斜,小产权房成了众多老百姓解决住房问题的重要选项。但由于小产权房不符合我国相关法律法规的规定,存在无法办理产权等各种风险,使得老百姓购小产权存在诸多隐忧。文章将从法律社会学的角度对小产权房问题进行探讨,拟从老百姓的根本利益出发,提出解决小产权房问题的建议。
The property rights issue has a long history. It is rooted in the complex and ever-changing social environment and is shaped by the rapidly developing market economy and the relatively lagging legal system. With the intensified competition in the real estate market and rising prices of commercial housing, the rigid housing demand of ordinary people has become a huge contradiction with high housing prices. More and more, the small property housing market has become an important option for many people to solve their housing problems. However, due to the small property room does not comply with the relevant laws and regulations of our country, there are various risks such as property rights can not be handled, so that people have a lot of hidden worries to buy small property rights. This article will discuss the issue of small property room from the perspective of legal sociology, and propose to propose the solution to the small property room problem from the fundamental interests of ordinary people.
