长期以来,学界针对行政事实行为的研究比较杂乱,行政事实行为概念本身存疑,相关的司法实践亦缺乏系统的指导。我国自1986年《民法通则》率先在第一百二十一条规定相应的行政侵权责任以来,行政事实行为侵权的可诉性逐步得到认可;针对行政事实行为侵权的救济制度也逐步从“行政确认诉讼+行政赔偿诉讼”二元模式过渡到“行政赔偿诉讼”一元模式。但在这其中,仍有许多相应的问题尚待厘清。
For a long time, the academic research on administrative factual behavior is quite messy. The concept of administrative factual behavior itself is in doubt. Relevant judicial practice lacks systematic guidance. Since 1986, the “General Principles of Civil Law” took the lead in Article 121 of the corresponding provisions of the administrative tort liability, the administrative action of the infringement of the lawsuit gradually recognized; for the administrative act of tort of the relief system is also gradually from Administrative Confirmation Litigation + Administrative Compensation Litigation “Binary Mode Transition to ” Administrative Compensation Litigation "Unitary Mode. But in this one, there are still many corresponding problems to be clarified.
