“法院是法律帝国的首都,法官是帝国的王侯。”美国著名法学家德沃金《法律帝国》中的这一名言形象地描述了司法者在全社会的权威与尊荣。法官、检察官是维护公平正义的最后一道防线,应当是正义的化身,但具体到每一个司法人员身上,谁都不是超级英雄,司法人员也只是一个有血有肉的凡夫俗子。在复杂的社会中,他们亦难以避免各种外在干扰, “The court is the capital of the legal empire and the judges are princes of the empire.” The famous American legal scientist Dworkin’s “Legal Empire” vividly portrays the judiciary’s authority and honor throughout society. Judges and prosecutors are the last line of defense for maintaining fairness and justice. They should be incarnations of justice. But to every judicial officer, no one is a superhero and the judicial officers are just flesh-and-blood ordinary people. In a complicated society, they also find it hard to avoid all kinds of external interference.
