2013年4月25日,《中华人民共和国旅游法》(以下简称《旅游法》)在十二届全国人大常委会第2次会议上通过,并将于2013年10月1日起正式实行。这也宣告着这部备受业界、学界期待,酝酿近30年之久,屡次上会又屡次下马的法律终将出台。《旅游法》是我国首次在法律层面上对旅游者和旅游经营者做出约束和保障,也给旅游相关部门的监督和管理提供了重要的法律依据。其中针对“零负团费”“导游资格及素质”“旅游投诉”“旅游开发与环境保护”等诸多方面,其法律条文对海南来说更是意义深远。
On April 25, 2013, the Travel Law of the People’s Republic of China (hereinafter referred to as the “Travel Law”) was passed at the 2nd meeting of the 12th NPC Standing Committee and will come into effect on October 1, 2013. This also proclaims that this law, which has been widely expected by the academic circles and brewed for nearly 30 years, has repeatedly been dismissed and will be promulgated. The “Law on Tourism” is the first time that China has made the restriction and guarantee for tourists and tour operators at the legal level. It also provides an important legal basis for the supervision and management of tourism-related departments. Among them, the legal provisions are far-reaching significance to Hainan in respect of such issues as “zero-paying tour ” “tour qualifications and qualifications ” “tourist complaints ” “tourism development and environmental protection ” and so on.
