1953年世界上第一个区域性的国际人权保护条约《欧洲人权公约》生效,它规定集体保障和施行《世界人权宣言》中所规定的某些权利及基本自由。经过几十年的发展,《公约》的影响越来越大,真正成为了欧洲的人权宪章。基于《公约》所建立起来的地区性人权保障体系与其他地区相比也是最久、最先进和最有效的。本文将以萨米人为对象,去研究北欧少数人权利的司法保护现状,同我国的相关制度比较,指出我国少数民族类似的权利在司法救济方面的不足,认识到宪法性权利的司法保护对于我国人权的发展具有重要的意义。
The entry into force of the 1945 European Convention on Human Rights, the first regional treaty on the international human rights in the world, provides for the collective guarantee and implementation of some of the rights and fundamental freedoms set forth in the Universal Declaration of Human Rights. After decades of development, the Convention has become more and more influential and has truly become the European Charter of Human Rights. The system of regional human rights guarantees established on the basis of the Convention is also the longest, most advanced and most effective compared to other regions. This article will take the Sami people as an object to study the status quo of the judicial protection of minorities’ rights in the Nordic countries. Compared with the relevant systems in our country, this article points out the inadequacy of similar rights of minority nationalities in judicial remedies and realizes that the judicial protection of constitutional rights is of great significance to our country The development of human rights is of great significance.
