代表人诉讼制度是解决多数当事人纠纷的诉讼方式,随着市场经济的深入发展,代表人诉讼方面的相关制度特别是其公告登记制度的弊端日益凸显出来。对此,本文认为有必要借鉴国外和境外群体诉讼制度的合理因素,结合我国的司法现状进一步改进和完善我国的登记公告制度以便充分发挥代表人诉讼在解决群体性纠纷方面的功能。 The representative litigation system is the litigation way to solve the dispute of most parties. With the deepening of market economy, the drawbacks of the representative litigation system, especially the announcement registration system, have become increasingly prominent. In this regard, this article thinks it is necessary to draw lessons from the reasonable factors of litigation system of foreign and overseas groups, and to improve and perfect the system of registration announcement in our country in order to give full play to the function of representative litigation in settling group disputes.
