《公务员法》中的“引咎辞职”制度无论是在制度设计,亦或是在具体实践过程中都存在种种问题。而产生这一系列问题的根源在于我们对“引咎辞职”制度这一舶来品未有客观、理性、正确的认识。没有认识到“引咎辞职”所体现的道德自发性与政治责任感是不能被法强制的。而想通过一劳永逸地将“引咎辞职”制度化来达到调高官员责任意识,打造责任政府是行不通的。与其这样,不如更加务实去地建立完整的行政道德伦理体系与加强外部力量的参与。
The system of blame and resignation in the Civil Servant Law has problems both in the design of the system and in the concrete practice. The root cause of this series of problems is that we do not have an objective, rational and correct understanding of the imported goods “system of blame and resignation”. Did not realize that the moral spontaneity and political responsibility embodied in “resignation” can not be enforced by law. However, it is not feasible to build a responsible government by institutionalizing “blame and resignation” once and for all so as to raise the awareness of officials’ responsibility. In this way, it is better to establish a complete ethics system of administrative ethics and strengthen the participation of external forces.
