现实生活中,小商贩作为一个以小规模商事经营为业的广大群体而存在。他们为人们的日常生活提供方便的同时,也为城市管理带来一系列问题。无照商贩与城市管理者之间矛盾的日益加剧,不仅引起公众舆论的广泛关注,也成为影响社会稳定和谐的重要因素。学界对小商贩法律地位的研究仅仅零碎地存在,相关立法也远远不能适应和满足对小商贩的管理与保护。本文在分析小商贩存在的合法化及法理基础上,探析小商贩商主体资格的认定,进而提出对小商贩进行法律保护的建议。
In real life, small traders exist as a large group of people who operate on a small scale. While they provide convenience to people’s daily life, they also bring a series of problems to urban management. The growing contradictions between unlicensed traders and urban managers have not only caused widespread public concern but also become an important factor affecting the stability and harmony of the society. The academic research on the legal status of small traders only exists fragmentedly, and the relevant legislation is far from being able to adapt and satisfy the management and protection of small traders. Based on the analysis of the legalization and legal principle of the existence of small-scale traders, this paper explores the identification of the main body of small-scale retailers and puts forward some suggestions on the legal protection of small traders.
