针对女工在工作中所面临的突出问题,南京国民政府1929年颁布的《工厂法》对女工权益给予了较多关注。但社会各界对一些相关政策却反应强烈,工商界普遍反对,有的社会学家也提出质疑。就当时工业发展的实际情形来看,有些政策确与现实情况严重脱节,实施起来困难重重。立法精神当与社会环境相适应,国民经济的贫弱落后,女工沉重的生存压力,是女工保护政策失效的根本原因。
In response to the prominent problems women workers face at work, the “Factory Law” promulgated by the Nanjing National Government in 1929 paid more attention to the rights and interests of women workers. However, all sectors of society have reacted strongly to some relevant policies, generally opposed by the business community, and some sociologists have also challenged it. Judging from the actual situation of industrial development at that time, some of the policies were really out of line with the reality and were difficult to implement. When the legislative spirit adapts to the social environment, the poor and backward national economy and the heavy pressure of subsistence of female workers are the fundamental reasons for the failure of the protection policy for female workers.
