由香港现任特首私宅僭建而引发的2012年末至2013年初的弹劾案无疑是《基本法》在弹劾制度上的一次最初尝试,本文从香港《基本法》构架下行政权与立法权的互动关系角度尝试理清香港弹劾制度的法理意义。香港的弹劾制度植根于普通法系下的政治制度架构,体现了《基本法)近年来“立法吸纳行政”的新的政治发展趋势,本文认为香港的弹劾制度实际上对香港传统的“行政主导制”形成了挑战和冲击,其本质在于《基本法》框架下立法权和行政权的二元互动,这种政治权力配置的变化实际上反映了民主政治力量对比关系的变化,该种互动机制应该被纳入法治化的轨道,从而一方面确保香港特区政府的稳定运转,另一方面推动香港民主政治的进一步发展。
The impeachment case from late 2012 to early 2013 triggered by Hong Kong’s current premier private house is undoubtedly an initial attempt by the Basic Law to impeach the impeachment system. This article attempts from the perspective of the interaction between the executive power and the legislative power under the framework of Hong Kong’s “Basic Law” To Understand the Legal Significance of the Impeachment System in Hong Kong. The interactive mechanism should be incorporated into the rule of law so as to ensure the stable operation of the SAR government and promote the further development of democracy in Hong Kong on the other hand.
