2001年在《婚姻法》修正案第40条中确立了家务劳动补偿制度,这一制度有利于提高妇女的社会地位,维护妇女的合法权益,有助于夫妻更好地构建和维护和谐稳定的婚姻家庭。但该制度仍存在一些适用上的不合理和不全面性,例如适用的前提过于狭窄,适用的范围过于片面,计量方法不明确。对于上述缺陷,我国可以根据实际情况借鉴国外立法,在适用前提上扩展适用于夫妻财产共同制,而不仅仅局限于分别财产制;在行使时间上也应延展适用于婚姻存续期间;法律上应明确家务劳动的计量方法,补偿标准可采机会成本与未来受益折现相结合的方式。
In 2001, Article 40 of the Amendment to the Marriage Law established the household labor compensation system, which is conducive to improving women’s social status, safeguarding the legitimate rights and interests of women, and helping couples to better build and maintain a harmonious and stable marriage family. However, there still exist some unreasonable and incomplete applicability of the system. For example, the applicable premise is too narrow, the applicable scope is too unilateral and the measurement method is not clear. In view of the above defects, our country can learn from foreign legislation according to the actual situation and extend its application to the common property system of husband and wife on the premise of its application, not just the separate property system; it should also be extended in the exercise time to the period of marriage; A clear measure of domestic labor, the standard of compensation can take the opportunity cost and the future benefit discount combination of ways.
