我国预备役法律制度经历了国内革命战争时的萌芽时期、新中国成立的建立时期以及党的十一届三中全会后全面发展时期。然而,随着中国特色社会主义建设和国家安全形势的发展,现行预备役法律制度已明显滞后于这一发展的需要,存在着预备役人员管理规定缺乏操作性,预备役军官培训方式难以满足军事斗争准备需要,预备役部队相关机制难以满足完成多样化军事任务需要,预备役人员优抚待遇影响预备役人员国防积极性等问题。因此,我国预备役法律制度需要在制定军地共建共管法律制度,制定预备役军官培训法律法规,健全预备役部队完成多样化军事任务的配套法规和完善预备役部队优抚法律制度上进一步完善。
The legal system of our country’s reserve system has experienced the embryonic period of the domestic revolutionary war, the founding period of the founding of New China and the period of post-round development after the Third Plenary Session of the 11th CPC Central Committee. However, with the development of socialism with Chinese characteristics and the development of the national security situation, the current legal system for reserve law has lagged far behind the need for this development. There are a lack of operational provisions in the management of reserve personnel. The training methods for reserve officers hardly meet the needs of military struggle preparations , The relevant mechanism of the reserve force can hardly meet the needs of fulfilling diversified military tasks and the special treatment of reservists has an impact on the enthusiasm of the reservists in their national defense. Therefore, our country’s reserve law system needs to be further perfected in formulating the legal system of military establishment and joint management, drafting the laws and regulations of reserve officers training, perfecting the supporting regulations of reserve forces to accomplish diversified military tasks and improving the legal system of special care for reserve forces.
