2009年底工商总局组织发起了对《消费者权益保护法》(以下简称“消法”)的修订工作。在各方代表讨论会上,部分学者坚持认为应将医疗、教育、房产、金融等产品类型纳入消法并制定相应细则,使其成为所有消费类型的“金钟罩”。本文通过探究三包制度的立法来源、基本原则、制度框架,剖析其客观存在的种种弊病,探讨其在当前经济形势和法律环境下继续存在的必要性。文中认为,与其针对不同产品制定复杂细则,不如借此契机摒弃原有的三包立法思路,建立统一完善的纠纷解决制度,使消法成为消费维权的平等之策、正义之策、长久之策。
At the end of 2009, SAIC organized the revision of the “Consumer Protection Law” (hereinafter referred to as “Consumer Law”). At the seminar on behalf of all parties, some scholars insisted that health care, education, real estate, finance and other product types should be included in the consumption law and the corresponding rules should be made into a “golden bell” for all consumer types. By studying the sources, basic principles and institutional framework of the Three Guarantees system, this article analyzes the shortcomings of its objective existence and discusses the necessity of its existence in the current economic and legal environment. The article holds that instead of formulating complex rules for different products, it is better to take this opportunity to abandon the original idea of the Three Guarantees legislation and establish a unified and perfect dispute resolution system so that consumption law can be used as an equal measure, a measure of justice and a long-term solution to consumer rights protection .
