我国现行的行政诉讼法第50条明确规定:人民法院审理行政案件,不适用调解。但大量的行政诉讼案件是原、被告在法院的默许乃至动员下通过协调、庭外工作等方式解决。在这样的实践背景下,显然,行政诉讼不适用调解的原则已经名存实亡。本文对行政诉讼调解机制引入的法理基础和现实基础进行探讨,在行政诉讼中引入调解机制有其充分的基础。
Article 50 of the current Administrative Procedure Law of our country clearly stipulates that: People’s courts shall not apply mediation when handling administrative cases. However, a large number of administrative litigation cases are the original, the defendant in the court acquiescence and even mobilized through coordination, out-of-court work and other ways. In such a practical context, it is clear that the principle that administrative proceedings do not apply to conciliation has existed in name only. This paper discusses the legal basis and the realistic basis of mediation mechanism in administrative litigation, and introduces the mediation mechanism in administrative litigation with its sufficient foundation.
