随着科技进步,大量新业态得到发展,在其成长的背后,预示着非标准劳动关系势在必行。然而非标准劳动关系目前仍存在概念界定不清、司法实践混乱、对于非全日制用工法律保护薄弱等问题,这对我国建立和谐劳动关系形成了挑战。因而有必要加强劳动合同法的包容性,认清非标准劳动关系的本质特征——劳动者对用人单位的组织从属性和技术从属性。将最低标准的保护与劳动力市场灵活性的要求相平衡,逐步规范非全日制用工,完善当前社会保险制度,提高劳动力市场的灵活性,以适应时代发展。
With the progress of science and technology, a large number of new business developments have taken place. The growth behind this indicates that non-standard labor relations are imperative. However, there are still unclear concepts, confusion in judicial practice and weak protection for part-time employment in non-standard labor relations. This poses a challenge to our country to establish harmonious labor relations. Therefore, it is necessary to strengthen the inclusiveness of the labor contract law and to recognize the essential characteristics of non-standard labor relations - the employer’s organizational and laborer dependencies. We will balance the protection of minimum standards with the requirements of labor market flexibility and gradually standardize part-time employment so as to improve the current social insurance system and increase the flexibility of the labor market so as to adapt to the development of the times.
