卡尔·波兰尼的市场-社会张力结构理论为经济法本质提供了一种新的解释框架,使得在现存的经济学视角之外能够另辟经济法的社会建构逻辑。依其社会视角,经济法的本质就是市场-社会结构张力的制序之法。依从这一逻辑,经济法的价值体系得以重构,并可从四个维度导出经济民主的元价值地位。在中国当前新一轮改革以“市场决定作用”为取向的语境下,社会建构逻辑的现实展开更加充分地揭示了经济民主的制度功能以及经济法提升民主含量的迫切性。弘扬经济民主的当下意义正在于唤醒经济分系统的社会共识,从而促成重回社会、政府、市场之间本然位序的理性进程。
Karl Polanyi’s market - the theory of social tension structure provides a new explanation framework for the essence of economic law, which enables it to open up the social construction logic of economic law beyond the existing economic perspective. According to its social perspective, the essence of economic law is the law of the order of market-social structure tension. According to this logic, the value system of economic law can be reconstructed and the value position of economy and democracy can be derived from four dimensions. Under the current new round of reform in China, “the role of market decisiveness” as the orientation, the reality of social construction logic fully reveals the institutional function of economic democracy and the urgency of economic law to enhance the democratic content. The present meaning of promoting economic democracy is to awaken the social consensus of the economic sub-system and thus promote the rational process of reverting to the prepositional order among society, government and the market.
