房屋权属登记,是指房屋行政主管部门代表政府对房屋所有权和居住权以及由上述权利产生的抵押权、典权等房屋他项权利进行登记,并依法确认房屋权归属关系的行为。国家实行房屋登记制度,目的在于保障权利人的合法权益,维护房屋交易秩序。房屋权属登记行为之所以是一种行政行为,是因为房屋权属登记行为体现了行政机关代表国家对房屋物权关系的干预。国家通过《中华人民共和国城市房地产管理法》等法律规定了房屋权属登记的条件、方法、内容,并要求房屋所有权人进行房屋权属登记。房屋权属登记行政行为是对房屋权属的法律关系的确认,是对权力所有人合法拥有权利的真实性的证明。
Housing ownership registration refers to the housing administration department on behalf of the government ownership of housing and residency and rights arising from the above rights such as mortgages, pawn and other housing rights to register, and in accordance with the law to confirm the ownership of housing rights. The state implements the housing registration system with the aim of safeguarding the legitimate rights and interests of the rights holders and maintaining the order of the house transactions. The reason why housing ownership registration is an administrative act is because the registration of housing ownership reflects the interference of administrative agencies on behalf of the state over the ownership of housing. The State stipulates the conditions, methods and contents of the registration of ownership of houses through the Law of the People’s Republic of China on Urban Real Estate Management and other laws, and requires the owners of houses to carry out the registration of the ownership of houses. The administrative act of housing ownership registration is the confirmation of the legal relationship of the ownership of housing and the proof of the authenticity of the legal ownership of the owner of power.
