【裁判要旨】单位工作人员擅自使用公车办理个人事务发生交通事故,单位对于交通事故是否承担赔偿责任,应区分不同情况处理。如果单位工作人员公车私用行为的外在表现形式仍属履行职务或者与履行职务有内在联系,对此应适用“外形理论”由单位直接承担赔偿责任。如果公车私用的情节并不符合这一条件限制,即不具有公务外形,则依法应由单位工作人员直接对受害方承担赔偿责任,单位应根据其过错程度承担相应的赔偿责任。
[Reasons for the referee] When a unit staff member uses a bus for handling personal matters without authorization, a traffic accident shall occur. If the unit is liable for compensation for traffic accidents, it should be handled differently depending on circumstances. If the external manifestations of bus private behavior of unit staff are still in performing their duties or are intrinsically linked to the performance of their duties, they should be subject to “shape theory ” by the unit directly liable for compensation. If the private bus does not meet the conditions of this condition does not meet, that is, does not have the official appearance, according to the unit staff should be directly liable to the injured party, the unit should bear the corresponding liability according to its fault.
