随着一带一路的推进,中医药科学家获得诺贝尔奖,《中医药法(草案)》获得全国人大常委一读通过,中医药获得了国内外的广泛关注,中医药服务贸易迎来了发展的“春天”。在此背景下,我们还须清醒地看到,中医药服务贸易虽然近期有快速发展的可能,但是总体上还处于低水平、无秩序、小规模的发展状态。由于和西方现代医学的理论基础和文化理念存在较大差异,中医药服务贸易发展过程中,既面临法律制度层面的挑战,也面临文化理念方面的冲突,既有行业标准层面的挑战,也有价值认同方面的冲突,既有贸易壁垒方面的问题,也有国民待遇问题。前述问题的解决,首先需要中医药在国内练好内功,其次需要在国际上构建一套有利于服务贸易发展的国际法律制度。本文试就如何构建符合中医药服务贸易发展需要的国际法律制度进行分析,并提出若干建议。
With the progress of the Belt and Road initiative, Chinese medicine scientists have won the Nobel Prize, and the “Chinese Medicine Law (Draft)” has won the first reading of the NPC Standing Committee. Traditional Chinese medicine has drawn wide attention both at home and abroad. The development of Chinese medicine trade in services has been developing “spring”. Against this background, we must also be soberly aware that despite the recent rapid development of traditional Chinese medicine service trade, it is still generally in a low-level, disorderly and small-scale development. Due to the big difference between the theoretical basis and the cultural concept of modern western medicine, the development of traditional Chinese medicine service trade not only faces the challenge of legal system but also the conflict of cultural concept. It not only has the challenge of industry standard but also has the value Conflicts of identity, both trade barriers and national treatment issues. The solution to the aforesaid problems requires that Chinese medicine practitioners should first practice internal strength in China and secondly, it is necessary to establish an international legal system conducive to the development of service trade in the world. This article tries to analyze how to construct an international legal system that meets the needs of the development of TCM service trade and puts forward some suggestions.
