《人民法院第三个五年改革纲要》规定,“最高人民法院、高级人民法院和中级人民法院遴选或招考法官,原则上从具有相关基层工作经验的法官或其他优秀的法律人才中择优录用”。由于体制上的多种原因,法官待遇偏低,人才流失严重,法官断层问题困绕着中基层法院、尤其是西部地区法院,中级法院从基层法院遴选人才存在着诸多的问题,文中以怀化市中级法院为视角,就所属的11个基层法院进行研究考察,在收集客观真实的数据、素材的基础上,运用实证分析的方法,对法官断层、流失问题进行剖析,为今后中院能从基层法院稳定地选拔到优秀人才,提出了解决问题的途径。
