《道路交通安全法》和《行政许可法》的施行,确立了农业(农业机械)主管部门的行政执法地位和执法内容。然而,却给现行的农机监理机构带来了一些问题。一是农机监理机构不具备行政执法主体资格;二是农机监理机构无上道路执法的权力;三是农机监理机构的职能发生了重大变化等等。这些问题的产生只有一个原因,那就是现行的农机监理机构是农业(农业机械)主管部门的下属事业单位,而非行政单位。解决问题的办法也只有一个,那就是尽快转变农机监理机构的事业性质,纳入依照公务员管理序列,并赋予其行政管理职能。本文从“两法”施行中存在的问题入手,提出了如何自觉运用“两法”规范当前农机安全监理工作,调整农机监理工作重心等观点。同时,笔者也强烈呼吁省有关职能部门要制定相关的政策、法规,来确定农机监理机构的行政执法地位。
The implementation of the Law on Road Traffic Safety and the Law on Administrative Licensing established the administrative law enforcement status and law enforcement content of the competent department of agriculture (agricultural machinery). However, it has brought some problems to the current agricultural supervision agencies. First, agricultural supervision agencies do not have the main body of administrative law enforcement; Second, agricultural supervision agencies without the power of road enforcement; Third, the functions of agricultural supervision agencies have undergone major changes and so on. There is only one reason for these problems, that is, the current agricultural supervision agency is a subordinate institution of the agricultural (agricultural machinery) authority, not an administrative unit. There is only one solution to the problem, that is, to change the nature of the undertaking of the agricultural machinery supervisory organ as soon as possible and to include them in the sequence of administration of civil servants and to give them the functions of administration. This article starts from the existing problems in the implementation of the “two laws” and puts forward some suggestions on how to conscientiously use the “two laws” to standardize the work of supervising agricultural machinery safety and adjusting the focus of agricultural supervision. At the same time, I also strongly urge the relevant functional departments in the province to formulate relevant policies and regulations to determine the administrative law enforcement status of agricultural machinery supervision agencies.
