近年来艺术品拍卖市场中拍卖赝品事件屡见不鲜,拍卖人和委托人经常利用《拍卖法》61条中“声名不保证”条款规避自己应当承担的法律责任。本文尝试从现有法律体系出发,对“声名不保证条款”规则进行全面理解。通过发掘《拍卖法》中的相应规则,对“声名不保证”条款进行规制,使艺术品拍卖中拍得赝品的买受人能够得到合理的救济。文章最后,适当结合现有的研究,再对未来《拍卖法》的修改提出一些个人认为可行的建议。
In recent years, auctions of art auction fake events are common, auctioneers and clients often use the “Auction Law” in 61 “reputation ” clause to circumvent the legal liability they should bear. This article attempts to proceed from the existing legal system and fully understand the “Terms of Reference for Non-guaranteed Terms”. Through the excavation of the corresponding rules in the Auction Law, the regulation of “not guaranty of ” is regulated so that the buyer of art auctioned fake goods can get reasonable relief. At the end of the article, some feasible suggestions are put forward according to the existing research and the modification of the future “Auction Law”.
