【裁判要旨】优先购买权具有法定性,在赋予承租人优先购买权的同时,也应保障出租人的合法权益,而并非牺牲出租人的权利来满足承租人的要求。出租人基于特殊身份关系以低于市场价格出卖租赁房屋,而离开该特殊身份关系,出租人则不愿出售房屋的,此时的承租人不符合法律规定的同等条件的要求,承租人一般不能行使优先购买权。□案号一审:(2014)浦民一(民)初字第25032号二审:(2015)沪一中民二(民)终字第98号
The purpose of the referee The preemptive right is statutory.
