This paper argues that in Marx’s theory, “justice ” is a notion of legal power with an attached and descriptive ideology. For Marx, “justice ” describes only the suitability of transactional and distribution systems as the mode of production, rather than a specific value orientation or the principle of what should be. Therefore, the capitalist’s unpaid possession of the surplus value of workers is not an “unjust” act. Marx did not condemn capitalism in the name of “injustice.”
