在社会转型期,劳资利益的博弈超出必要限度会引发劳资冲突,因此,将“有效政府”理念引入劳动监察制度可以充分发挥劳动权保护的功能,并通过在价值理念上确立劳资利益衡平,在监管运作中采用协商等柔性手段抗衡企业单决制,以最终实现劳资和谐,即承认利益差别基础之上的符合实质正义的和谐。
