作为一种制约意义上的监督,检察机关对行政执法活动开展法律监督所指向的是政治民主、行政合法以及国家、集体乃至公民个人的合法权益不受侵犯和法律的权威受到应有的尊重。然而,法律依据不充分、监督方式乏力以及履职独立性未获保障等问题却实然地给检察机关顺利开展行政执法法律监督工作设置了屏障。党的十八届四中全《决定》中关于检察机关法律监督的表述赋予了检察机关新的履职要求,因而,有必要以此为契机,进一步完善检察机关开展行政执法监督的制度设计,为其充分发挥行政执法监督职能提供明确具体的法律依据和相应的制度保障。
As a kind of restrictive supervision, the procuratorial organs carry out legal supervision on administrative law-enforcement activities, pointing to political democracy, administrative legitimacy and inviolability of the lawful rights and interests of the state, the collective and individual citizens, and the due respect for the authority of law. However, inadequate legal basis, weak supervision methods and the failure to guarantee the independence of duty performance actually provide a barrier for the procuratorial organs to smoothly carry out legal supervision of administrative law enforcement. Therefore, it is necessary to use this as an opportunity to further improve the system design for procuratorial organs to carry out the supervision of administrative law enforcement, For it to give full play to the administrative law enforcement supervision function to provide a clear and specific legal basis and the corresponding system of security.
