2007年通过的《反垄断法》专设一章规定了对“经营者集中”的规制,这些制度的设计,在未来实践中可能会产生不少问题,所以细节处有待完善。然而与我国同为发展中国家的南非是在竞争法方面立法相对成熟的发展中国家。在此,本文基于发展中国家这个大背景下,拟对两国在经营者集中法律规制方面的进行立法比较,以期进一步优化我国的《反垄断法》在经营者集中方面的立法。
The “Antitrust Law” passed in 2007 stipulates the regulation of “concentration of operators ”. The design of these systems may cause many problems in future practice. Therefore, details are to be improved. However, South Africa, which is also a developing country with our own, is a relatively mature legislator in the area of competition law. Here, based on the background of developing countries, this article intends to compare the legislatures of the two countries in the legal regulation of concentration of operators, with a view to further optimizing the legislation on the concentration of operators in China’s Anti-monopoly Law.
