早期的大量研究常常将“赔命价”的形成指向宗教观念的影响,或是现代法治观念的淡薄,并断然认定“赔命价”是落后的,亟待国家干预。然而,作为制度的“赔命价”既然长期稳定存在,必定有其适应于藏区严酷的自然、社会环境的相对合理性。因此,如何有效地将其纳入统一的全国法治框架,就应着眼于长期,渐进地改变当地的社会经济与生活结构,而非简单地诉诸道德批判或强力干预。
A large number of early studies often pointed to the influence of religious values or the weakening of the modern concept of the rule of law, and categorically decided that “the loss of life value” is backward and that state intervention is urgently needed. However, since the long-term stability exists as a system, it must be adapted to the relative rationality of the harsh natural and social environment in the Tibetan areas. Therefore, how to effectively incorporate it into a unified framework of the rule of law in our country, we should focus on long-term and gradual changes in the local social economy and living structure instead of simply resorting to moral criticism or intense intervention.
