《侵权责任法》规定了劳务派遣形式下,发生工作人员执行工作任务侵权时,用人单位的补充责任。在海上运输业中,大量存在船员劳务派遣,而船员常因其过错造成船舶碰撞侵权。本文通过分析《侵权责任法》第34条规定对劳务派遣下用人单位责任规定的法理基础及价值、以及该规定对船舶碰撞侵权责任的适用,提出了完善我国用人单位责任对船舶碰撞侵权责任的立法及司法建议。
The Tort Liability Law stipulates that under the form of labor dispatch, the employer’s supplementary liability occurs when an infringement of the staff’s performance of the work task occurs. In the maritime transport industry, there is a large number of seafarers dispatched while crew members often cause collision and infringement of ships due to their fault. This article analyzes the jurisprudence basis and value of the provisions of Article 34 of Tort Liability Law on the employer’s responsibility under labor dispatch and its application to the responsibility of collision and infringement of ships, Legislation and judicial advice.
