2013年3月,最高人民法院《关于违法的建筑物、构筑物、设施等强制拆除问题的批复》指出,对涉及违反城乡规划法的违法建筑物、构筑物、设施等的强制拆除,法律已经授予行政机关强制执行权,人民法院不受理行政机关提出的非诉行政执行申请。该批复的出台统一了违章建筑强拆的法律适用问题,也反映出了对规则缺失下我国非诉行政执行存在的诸多问题日益凸显。我国现行的非诉行政执行制度设立初衷在于力求兼顾保障人权和保证行政效率,但是由于在其形成过程中缺乏系统的理论设计和统一的思想指导,该制度本身存在许多缺陷,在运行中也出现了一些问题,难以实现建立该制度的初衷,很有必要对现行的非诉行政执行制度进行反思和完善。

Therefore, it is very necessary to reflect and perfect the current non-litigation administrative enforcement system.
