《法律选编》是拜占庭帝国皇帝利奥三世与君士坦丁五世于740(741)年联合颁布的一部小型实用法典。该法典首次明确提出的提升“仁爱”原则和相关法律条文所体现出的“仁爱”精神,使其成为继查士丁尼《民法大全》后罗马-拜占庭帝国史上又一部重要官方法典。在帝国皇权不断强化态势下,《法律选编》“仁爱”原则的提出,并非皇帝的仁慈使然,而与当时的社会环境有很大关系,主要表现在天灾人祸引起的人口锐减,教会“博爱”思想激起的人文关怀,客观上迫使皇帝在追逐皇权至上原则的同时,不得不屈就以“仁爱”原则来维护帝国的稳定,促进帝国的繁荣。
The Law Collection is a small, practical code that was jointly promulgated by the Byzantine emperor Leo III and Constantine V in 740 (741). The “benevolence” spirit embodied in the principle of ascension and “benevolence” first clearly proposed by the Code and made it another important post in Roman-Byzantine Empire after Justinian “Civil Law Encyclopedia” Official Code. With the continuous strengthening of imperial imperial power, the principle of “election of law” and “benevolence” was not the kindness of the emperor but a great relation with the social environment at that time. It was mainly manifested in the sharp population decline caused by natural disasters and man-made disasters, Humane care aroused by the thought of “fraternity” objectively forced the emperor to chase the principle of the supremacy of imperial power and at the same time forced to give up the principle of “benevolence” to safeguard the stability of the empire and promote the prosperity of the empire.
