保护消费者权益具有终极和最高的价值,无论如何强调都不为过。然而消费者保护的传统模式,无视消费者的行权成本,无力也不可能解决消费者与经营者不对等博弈的局面,必须予以革命性转变。转变的出路和重点即为构建消费者与经营者对等博弈的制度机制。当然,消费者保护任重道远,不单单是《消法》的任务,也是反垄断法、反不正当竞争法等市场经济法治的重要使命。
Protecting the rights and interests of consumers has the ultimate and highest value, no matter how to emphasize it. However, the traditional mode of consumer protection, disregarding the exercise cost of consumers, is unable or impossible to solve the situation of unequal game between consumers and operators and must be revolutionized. The way to change and the key point are to establish the institutional mechanism of equal game between consumers and managers. Of course, consumer protection has a long way to go and it is not only a task of eliminating the law but also an important mission of the market economy and the rule of law such as the anti-monopoly law and the unfair competition law.
