分析中国法官的遴选与退出机制,可以发现,中国法官群体是低同质化的,因而其对于不同激励因素的态度也存在较高程度的分化,与同质化的西方法官群体相比具有相当大的差异。因此,中国法官的外部环境约束既不同于英美法系法官,也不同于大陆法系法官,而主要体现在科层制的行政化管理体制、严格的法条主义和能动的服务于本系统的利益三大方面。未来的司法改革需要注意法官的外部环境约束才能更好地发挥效果。
An analysis of Chinese judges’ selection and withdrawal mechanisms shows that the Chinese judge community is of low homogeneity, and therefore its attitude towards different motivational factors is also highly differentiated, which is comparable to that of the homogenous Western judge community Big difference. Therefore, the external environment restraint of Chinese judges differs from that of Anglo-American legal system judges and Continental legal system judges mainly in bureaucratic administrative management system, strict legal system and active service in the system Three aspects of interest. Future judicial reform needs to pay attention to the judge’s external environment constraints in order to better play its effect.
