本文从作为社会实践主体的人的能动性的具体形态入手,分析支持古典自由心证制度确立的人的精神状态,也即本文重在分析支撑这一制度存在的主体精神的具体形式。
This article starts with the concrete forms of the man’s initiative as the main body of social practice, and analyzes the mental state of the people who support the establishment of the classical free proof of evidence system. That is, this article focuses on analyzing the concrete forms of the subjective spirit that supports the existence of this system.
