土地行政诉讼中存在大量的疑难问题,这些问题的产生与现行土地法律规范的缺位和滞后不无关系。如何在法律制度“供给不足”的情况下,合法合理地解决好土地法律争议,关键在于发挥司法能动精神,依托学理解释合理创制规则,弥补法律条文本身的不足,及时有效地回应社会生活的现实需求。本文从土地使用权制度、土地出让制度和安置补助制度三个方面入手,就土地实际使用人原告资格、土地使用权人的债权人原告主体资格、“闲置土地满两年”起算点、开发区管委会土地出让主体资格、征地补偿、安置争议裁决程序和征用土地安置补助费享有主体六个问题展开分析,提出合理的司法应对之策。
There are a large number of difficult problems in the land administration litigation. The emergence of these problems is related to the absence and lag of the current land legal norms. How to solve the legal disputes of land lawfully and reasonably under the condition of legal system “insufficient supply ”, the key lies in exerting the spirit of judicial initiative, relying on the theory to explain the rules of reasonable creation, making up for the shortcomings of the legal provisions themselves, and timely and effectively responding to the social life Realistic needs. This article starts from the following three aspects: the land use right system, the land transfer system and the resettlement subsidy system. In the light of the qualification of the plaintiff of the actual land user, the qualification of the plaintiff of the land use right owner and The qualification of land transfer main body, land compensation, resettlement dispute adjudication procedure and land acquisition subsidy of district administrative committee enjoy six main subjects and analyze the problems, and propose a reasonable judicial countermeasure.
