1890年的《谢尔曼法》奠定了美国反垄断法的基础。《谢尔曼法》有8条,其核心在于两点:1.禁止任何限制贸易活动的合同和勾结:2.宣布各种垄断与局部垄断贸易及商业活动是非法的,它也赋予受害方提起3倍损害赔偿诉讼的权利。但是由于《谢尔曼法》的首创性及反垄断法的不确定性,它的规定存在着许多过于简单和模糊之处。
The Sherman Act of 1890 laid the foundation of U.S. antitrust law. The “Sherman Act” has eight articles and its core lies in two points: 1.
