一、缘起:从普通信用卡盗刷案到JCB条款的启示案例一:原告余铜海为某行信用卡的持卡人。其信用卡正面印有与持卡人姓名发音相同的汉语拼音凸字,背面有持卡人签名栏。原告在填写该信用卡申请表时,预留了“余铜海”的签名样式。2005年11月26日晚,原告发现信用卡遗失,向该行信用卡中心挂失并向公安机关报案。经查询,该信用卡已被他人冒用,在上海城隍庙第一购物中心有限公司堂内的POS终端上,先后刷卡消费两次,在签购单签名栏处留有“余钢海”、
First, the origin: From ordinary credit card fraud cases to JCB Enlightenment Case 1: The plaintiff Yu Tong Hai for a credit card holder. The front of the credit card has the same pinyin name as the cardholder’s name, with the cardholder’s signature on the back. The plaintiff reserved the signature style “Yu Tong Hai” when completing the credit card application form. On the night of November 26, 2005, the plaintiff found that his credit card was lost, reported the loss to the bank’s credit card center, and reported the case to the public security organ. Upon inquiry, the credit card has been fraudulently used by others. At the POS terminal in the first shopping mall of Shanghai Chenghuang Temple, the credit card has spent two times in credit card payment and left “Yu Ganghai” at the signing signpost.
