农村土地集约化经营是实现农村经济发展方式转变的重要内容,是实现农业现代化的必然要求,为新型城镇化奠定了坚实的基础。当前,我国法律制度和社会经济因素制约着农村土地集约化经营。实现农村土地集约化经营,必须要完善对农村土地经营规模的法律规制。要强化适度的农村土地经营规模的直接规制,一要建立适度的农村土地经营规模的标准制度,二要建立法定面积农村土地强制整理的制度。要加强农村土地经营规模的间接规制,一要放松经营主体的规制,二要放松流转方式的规制,三要加强社会保障制度建设。
Intensive management of rural land is an important part of realizing the transformation of the mode of rural economic development and an inevitable requirement for the realization of agricultural modernization, laying a solid foundation for the new-type urbanization. At present, China’s legal system and socio-economic factors restrict the intensive management of rural land. To realize the intensive management of rural land, we must improve the legal regulation of the scale of rural land management. To strengthen the proper regulation of the scale of rural land management, it is necessary to establish a standard system of moderate scale of rural land management and to establish a system of compulsory land consolidation in rural areas in a legal area. To strengthen the indirect regulation of the scale of rural land management, we must relax the regulation of the main business, we must relax the regulation of the mode of circulation, and third, we must strengthen the social security system.
