外空发射服务是一种新兴的竞争激烈的商业性服务,印度在外空发射服务法律制度建设方面成果显著。印度《卫星通信政策程序》和《卫星通信的规范、准则和程序》,允许国内的私人企业参与商业外空发射服务,并通过许可制度来进行管理。为了防止外空发射服务危及国家及国际安全,印度通过WMD法令等法律法规对与外空发射相关的关键的技术和装置、部件的流通和扩散进行严格的管制。印度在空间发射服务方面的立法实践对于我国在这方面的空间立法具有积极的借鉴意义。
The launching of outer space services is a new and highly competitive commercial service. India has made remarkable achievements in building a legal system for outer space launch services. India’s “Satellite Communications Policy Procedure” and “Norms, Guidelines and Procedures for Satellite Communications” allow domestic private enterprises to participate in commercial space launch services and manage them through a licensing system. In order to prevent the launching of outer space services from endangering national and international security, India strictly controls the circulation and proliferation of key technologies, devices and components related to the launching of outer space through laws and regulations such as the WMD Act. India’s legislative practice in space launch service has positive reference for our country’s space legislation in this respect.
