小产权房的问题已成为近几年来人们议论的焦点。小产权房的房屋买卖成为难题是在房价畸高以及政府对其打击力度加大的情况下产生,房价畸高使得中低收入者买房困难,而政府的打击力度又使得小产权房的房屋买卖交易不受法律保护。如此两难的境地使得小产权房一直处于尴尬的境地。学界不少人认为,要根本上解决小产权房的问题,应该采取“堵”不如“疏”的方法,使小产权房合法化。本文主要从其必要性和可行性方面论证小产权房应该合法化。
