伴随着全球国际环境保护运动,国际环境法逐渐发展成为现代国际法的一个最新分支。本文认为,国际环境法是指国际法主体(主要是国家)在因开发、利用、保护和改善环境而发生的国际交往中形成的,体现它们之间由其社会经济结构决定的,在开发、利用、保护和改善环境方面的协调意志的,调整国际环境法律关系的法律规范的总和。从其功能和内容上看,国际环境法已经初步形成了其法律体系。与传统的国际法及其各个部门相比,国际环境法具有公益性、科技性、综合性、早期性、超前性和区域性等特点;这些特点也反应了现代国际法在国际环境保护领域的最新发展。
Along with the global international environmental protection movement, international environmental law has gradually developed into a new branch of modern international law. This article argues that international environmental law refers to the main body of international law (mainly the state) formed by the development, utilization, protection and improvement of the environment in international exchanges that take place between themselves and their socio-economic structures, and their development and utilization , The will to protect and improve the coordination of the environment, and the legal norms that regulate the legal relations in international environment. From its function and content point of view, international environmental law has initially formed its legal system. Compared with the traditional international law and its various departments, international environmental law is characterized by commonweal, science and technology, comprehensiveness, early nature, advancedness and regional characteristics. These characteristics also reflect the latest development of modern international law in the field of international environmental protection .
