教师作为重要的教育法律关系主体,其教育法律素养关系到教育教学活动能否依法治教。据调查,目前中小学教师在教育法律素养方面存在的主要问题是:缺乏对教育法律体系的全面认识;缺少正规学习教育法律知识的途径;理解和掌握教育法律知识的程度不够;不能正确处理教育法律纠纷。提高中小学教师的教育法律素养,可以采取以下措施:更新理念,加强教师教育法律素养;健全和完善教育法律体系;在师资的培养与培训中开展教育法课程的学习;在教育教学活动中全面提高教师的教育法律素养。
