在单用途预付卡领域,常常发生“买卡容易退卡难”、“承诺容易兑现难”等侵害消费者权益现象,以致预付卡纠纷在整个消费者侵权案中占有相当的比重。尽管我国已有相关法律规定来规范预付式消费中的问题,然而面对层出不穷的单用途预付卡乱象,仅倡导消费者理性消费或者通过法律的规制仍不足以保护消费者权益。因此,文章认为我国应在综合慈溪、上海、宁波等地管理经验的基础上,以社会协同治理路径来规范单用途预付卡消费市场。
In the field of single-use prepaid card, it often happens that “easy to buy a card ”, “promise easy to cash hard ” and other violations of the rights and interests of consumers, resulting in pre-paid card disputes in the entire consumer infringement account for a considerable proportion . Despite the relevant laws and regulations in our country to regulate the problems in prepaid consumption, however, in the face of endless chaos of single-use prepaid cards, it is still not enough to advocate consumers ’rational consumption or the legal regulation to protect consumers’ rights and interests. Therefore, the article holds that our country should standardize the single-use prepaid card consumer market on the basis of comprehensive management experience of Cixi, Shanghai and Ningbo.
